PHOTOBOOTH RENTAL AGREEMENT

 

This Photobooth Rental Agreement ("Agreement") is entered into between BY JAKE PTY LTD, trading as Picture This Events, hereinafter referred to as the "Company," and the undersigned client, hereinafter referred to as the "Client."

 

EVENT DETAILS:

 

1. Event Date and Time:

   - Date: As per Quote

   - Start Time: As per Quote

   - End Time: As per Quote

 

2. Event Location:

   - Venue Name: As per Quote

   - Address: As per Quote

 

RENTAL PACKAGE:

 

3. Rental Package:

   - The Client agrees to rent a photobooth for the duration specified in Section 1.

 

4. Rental Fee:

   - The Client agrees to pay the total rental fee of Amount Quoted for the specified duration.

   - Payment is due as outlined in Section 9.

 

PHOTOBOOTH OPERATION:

 

5. Setup and Operation:

   - The Company will professionally set up and dismantle the photobooth at the specified venue.

 

6. Responsibility:

   - The Client is responsible for providing a secure and suitable location for the photobooth.

 

7. Guest Conduct:

   - The Client is responsible for ensuring that guests use the photobooth safely and appropriately.

 

TERMS AND CONDITIONS:

 

8. Booking Confirmation:

   - A booking is considered confirmed upon payment of costs as outlined under "payments," return of the booking form, and receipt of confirmation from Picture This Events.

 

9. Payments:

   - To confirm the booking date, a 50% deposit is required. (Refundable due to COVID—please refer to section 18.)

   - The balance is due 14 days before the event. Failure to meet this deadline may result in cancellation (with no refund of the deposit).

   - Additional hours beyond the agreed duration will be billed at the hourly rate specified in the photo booth rates.

 

10. Access, Space & Power Requirements:

    - The client must ensure a safe environment, including a 4m x 4m space, access to 240v power within 10m, and minimum 80cm-wide doorways and access paths. An undercover area is mandatory for outdoor events in case of poor weather.

    - The client is responsible for venue-related charges, including parking and electricity.

 

11. Changes & Cancellations:

    - Changes must be notified 30 days before the original event date, subject to availability and completion of a new booking form.

    - Cancellations result in the client forfeiting the deposit. Cancellations over 30 days prior to the event provide a credit for the deposit's value for future use (within 6 months). Cancellations within 30 days forfeit all payments. Picture This Events reserves the right to cancel any booking, with a full refund to the client.

 

12. Damage to Equipment:

    - Picture This Events reserves the right to deny service to any person to protect equipment.

    - In case of threats, harm, damage, or violence, Picture This Events may cease services. Damages to equipment during the event caused by the client or guests will incur repair/replacement costs, covered by the client.

 

13. Use of Images:

    - The client grants permission for all event photos' use on Picture This Events' website and promotional media. If the client wishes to exclude photos from social media, please notify Picture This Events upon booking.

 

14. Indemnification:

    - Picture This Events is not responsible for circumstances beyond their control (fire, accidents, civil commotion, acts of nature, equipment failure). Every effort will be made to provide service or find a suitable replacement. If not possible, the client will receive a refund equal to the booking cost.

    - The client agrees that Picture This Events' liability is limited to the booking cost and is not liable for indirect or consequential damages.

 

15. Booth Attendant(s):

    - For bookings exceeding 4 hours, a supplier meal is required.

 

16. Children's Supervision:

    - All children under 10 must have parental supervision when using the photobooth.

 

17. Technical Issues Compensation:

    - In case of technical issues or lateness, compensation will be provided with additional time added to the booth run time or a refund.

 

18. COVID Policy:

    - In the event of restrictions or lockdowns, clients are offered two options: unlimited postponements or a full refund.

 

19. Severability:

    - If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will still be valid and enforceable.

 

ACCEPTANCE:

 

By signing below, the Client acknowledges that they have read, understood, and agree to the terms and conditions of this Photobooth Rental Agreement.
